Terms and Conditions
These Terms govern your access to and use of MangaToucan. By downloading, accessing, purchasing, or using the app, you agree to be bound by these Terms. If you do not agree, do not use MangaToucan.
1. Acceptance
These Terms apply to your use of the app and related features made available through the app. They are intended to apply to the maximum extent permitted by law and subject to any non-waivable rights that apply in your jurisdiction.
2. Eligibility
MangaToucan is intended only for users who are at least 18 years old. If you are under 18, you must not create a profile, purchase a membership, or use the app.
3. Scope of the service
MangaToucan is a browser-based manga viewing enhancement app. The app displays web content you choose to access and may apply AI colorization on your device to supported images while you view that content. MangaToucan does not represent that it owns, licenses, republishes, sells, or distributes third-party manga content.
4. Your responsibility for source content
You are solely responsible for the websites, services, and content you access through the app. You may only use MangaToucan with content you are lawfully entitled to access, and you remain responsible for complying with the law and with the terms, licenses, paywalls, subscriptions, account restrictions, and access conditions imposed by the source website or service.
5. No circumvention or misuse
You must not use MangaToucan to bypass or interfere with paywalls, subscriptions, DRM, login gates, anti-bot measures, rate limits, geo-restrictions, copyright controls, watermarking, or any other technical or contractual restriction. You must not use the app to scrape, mass-download, redistribute, commercially exploit, or automate access to third-party content in violation of law or third-party rights.
6. Membership and access
Certain app features require an active membership entitlement. Membership status is determined by Apple StoreKit entitlements on the device. Optional sign-in methods in the app do not by themselves grant paid access. If no active entitlement is present, app access remains restricted until a valid purchase or restore is completed.
7. Billing, trials, renewal, and restore
Paid access is handled by Apple through In-App Purchase. Subscription pricing, free trials, automatic renewal, billing dates, cancellations, refunds, family sharing rules if any, payment methods, and restore behavior are governed by Apple’s terms, StoreKit, and your Apple account settings. MangaToucan does not directly charge your payment card and does not control Apple’s billing decisions, renewal timing, refund decisions, or sandbox review behavior.
8. Optional sign-in
MangaToucan may offer optional sign-in methods such as Apple, Google, or local email-based sign-in. Those sign-in methods are provided for device-level identity convenience and onboarding continuity. In the current version of the app, they are not a substitute for a valid Apple membership entitlement and they do not create a general server-side MangaToucan account database.
9. Third-party websites and providers
The app may display or interact with third-party websites and may rely on Apple, Google, and other platform or identity providers you choose to use. Those third parties operate under their own terms, privacy policies, billing rules, content practices, and operational constraints. MangaToucan is not responsible for third-party content, website availability, access decisions, subscription status on third-party sites, or acts or omissions of third-party providers.
10. AI output disclaimer
The app’s colorization output is generated by AI and may be inaccurate, incomplete, delayed, visually inconsistent, artistically different from official material, or unsuitable for your intended use. Colorized output is provided for personal viewing enhancement only and does not create or imply any official, publisher-approved, or licensed version of the underlying work.
11. Intellectual property and license limits
MangaToucan and its app software, branding, interface, and original materials are protected by applicable intellectual-property law. Third-party manga, images, site branding, and related materials remain the property of their respective owners. Subject to these Terms, you are granted a limited, non-exclusive, non-transferable, revocable right to use the app for personal, lawful use. You may not copy, distribute, sell, sublicense, modify, or exploit the app except as allowed by law.
12. Prohibited conduct
You must not use the app for unlawful, infringing, abusive, deceptive, harmful, or commercially exploitative purposes. You must not attempt to tamper with app behavior, defeat app restrictions, extract hidden credentials, abuse purchase flows, interfere with security features, or reverse engineer the app except to the limited extent such restriction is prohibited by applicable law.
13. No warranty
To the maximum extent permitted by law, MangaToucan is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, or error-free operation.
14. Limitation of liability
To the fullest extent permitted by law, MangaToucan will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or similar damages, or for loss of data, loss of access, loss of profits, business interruption, device issues, or claims arising from third-party content or services. Where liability cannot legally be excluded, it is limited to the greater of the amount you paid for the app in the 12 months before the claim or USD $50.
15. Suspension, termination, and availability
App features may change, be limited, or become unavailable at any time. Access may be limited or terminated where permitted by law if you misuse the app, violate these Terms, create legal or security risk, or attempt to interfere with the app, other users, rights holders, or providers.
16. Changes to these Terms
These Terms may be updated from time to time to reflect product, legal, billing, security, or operational changes. If changes are material, notice may be provided in the app or by another appropriate method. Continued use after the updated Terms take effect means you accept the revised Terms, except where applicable law requires a different process.
17. Consumer rights and governing law
These Terms are intended to apply subject to any mandatory consumer-protection, privacy, data-protection, subscription, or other rights that cannot legally be waived in your place of residence. Nothing in these Terms limits rights you are entitled to under applicable law.
